SUMMARY:

 

Attached are summary recommendations with respect to charter applications. A total of 17 charter actions are recommended involving 17 institutions, including 1 museum, 3 libraries, 10 nonpublic schools, and 3 chartered postsecondary institutions.

 

I recommend that the Regents approve each application in accordance with the recommendations contained in the respective summaries.


 

 

l. Cultural Education

 

 

ABSOLUTE CHARTERS

 

 

No. 1

 

D. R. EVARTS LIBRARY DISTRICT

 

Athens, Greene County

 

The board of trustees has petitioned the Board of Regents to form a corporation  to provide library services to the residents of the D. R. Evarts Library District which was created pursuant to Chapter 313 of the Laws of 2004. The Office of Cultural Education recommends that an absolute charter in the first instance be granted.

HORICON FREE PUBLIC LIBRARY

 

Horicon, Warren County

 

A provisional charter was granted to this corporation by action of the Board of Regents on January 17, 1984 to operate an association library to serve the residents of the town of Horicon. Such provisional charter was extended by Regents action on February 16, 1990, April 28, 1995 and September 15, 2000. The board of trustees has applied for an absolute charter. The Office of Cultural Education recommends that the provisional charter be made absolute.

Troy, Rensselaer County

 

An absolute charter in the first instance was granted to this corporation by action of the Board of Regents under the corporate name “Rensselaer County Junior Museum” on May 21, 1954 to operate a junior museum. Such absolute charter was amended by Regents action on December 15, 1995 to change the corporate name to “The Junior Museum.” The board of trustees has applied for an amendment to the absolute charter to authorize the corporation to change the corporate name to “The Children’s Museum of Science and Technology” and to change the corporate address to 250 Jordan Road, Troy, New York 12180. The Office of Cultural Education recommends that the absolute charter be amended accordingly.

SHELTER ROCK PUBLIC LIBRARY

 

Albertson, Nassau County

 

A provisional charter was granted to this corporation by action of the Board of Regents on August 24, 1962 to operate a free public library. Such provisional charter was made absolute by Regents action on January 26, 1968. The board of trustees has applied for an amendment to the absolute charter to authorize the corporation to expand the service area as authorized by Chapter 972 of the Laws of 1962. A provisional charter was granted to this corporation by action of the Board of Regents as a stock corporation under the corporate name “The Alcott School, Inc.” on January 29, 1969 to operate a Montessori school for children of pre-kindergarten, kindergarten and post-kindergarten ages. Such provisional charter was made absolute by Regents action on March 24, 1972. Such absolute charter was amended by Regents action on September 26, 1975, September 22, 1978 to, among other items, delete the suffix “Inc.” from the corporate name, March 27, 1992 to change the corporate name to “Alcott School” among other items, September 24, 1993 and February 4, 1997. The board of trustees has applied for an amendment to the absolute charter to restate the corporate purposes. The Office of Nonpublic School Services recommends that the absolute charter be amended accordingly.

A provisional charter was granted to this corporation by action of the Board of Regents under the corporate name “Big Apple Play School” on June 23, 1978 to operate a nursery school and kindergarten. Such provisional charter was amended by Regents action on March 27, 1981 to change the corporate name to “Big Apple Day School”; to provisionally authorize the corporation to operate grades one through eight until June 30, 1984; to add language necessary to maintain tax-exempt status under Internal Revenue Code §501(c)(3) and, as so amended, made absolute by Regents action. The board of trustees has applied for an amendment to the absolute charter to delete the provisional authority granted on March 27,1981 to operate grades one through eight  and to add authority for the corporation to also operate day care centers. The Office of Nonpublic School Services recommends that the absolute charter be amended accordingly.

A provisional charter was granted to this corporation by action of the Board of Regents under the corporate name “Town of Clayton Pre-School Program” on May 26, 1978 to operate a preschool. Such provisional charter was amended by Regents action on October 23, 1981 to change the corporate name to “Clayton Area Pre-School,” and made absolute by Regents action on December 14, 1984. The board of trustees has applied for an amendment to the absolute charter to change the corporate address to 913 Strawberry Lane, Clayton, New York 13624 and to add authority for the corporation to also operate day care centers. The Office of Nonpublic School Services recommends that the absolute charter be amended accordingly.

An absolute charter in the first instance was granted to this corporation by action of the Board of Regents under the corporate name “The Westchester Conservatory of Music” on December 20, 1996 to operate an educational institution where students may get instruction in music and the arts. Such absolute charter was amended by Regents action on September 19, 1997 to change the corporate name to “The Music Conservatory of Westchester.” The board of trustees has applied for an amendment to the absolute charter to increase the maximum authorized number of trustees from  twenty-five to thirty-five. The Office of Nonpublic School Services recommends that the absolute charter be amended accordingly.

SCHOOL FOR LANGUAGE AND COMMUNICATION DEVELOPMENT

 

Glen Cove, Nassau County

 

A provisional charter was granted to this corporation by action of the Board of Regents under the corporate name “School for Language and Communication Disorders” on March 22, 1985 to provide preschool and kindergarten educational programs for mentally retarded and developmentally disabled children with language and communication disorders. Such provisional charter was amended by Regents action on June 19, 1987 to change the corporate name to “School for Language and Communication Development” and to add authority for the School to also operate a preschool, kindergarten and grade one through three elementary school for mentally retarded and developmentally disabled children with language and communication disorders and a preschool and kindergarten for non-disabled children and, as so amended, extended. Such provisional charter was further amended by Regents action on September 18, 1992 to change the corporate address and to delete the School’s authority to operate a preschool and kindergarten for non-disabled children and, as so amended, made absolute.  Such absolute charter was amended by Regents action on June 9, 1995 to restore the School’s authority to operate a preschool and kindergarten for non-disabled children and to add authority for the School to also operate a day care center pursuant to §460-a of the Social Services Law; July 16, 1999 to change the corporate address and to add authority for a provisional term of five years for the School to also operate a grade one through twelve elementary and secondary school for non-disabled children; December 17, 1999 to add authority for a provisional term of five years to operate a grade four through six program for children with disabilities; and October 5, 2001 to add provisional authority, until December 17, 2004, for the School to also service children with disabilities from 5 to 21 years of age; and to add authority to service children with disabilities including but not limited to the following categories: mental retardation, hearing impairment, speech and language impairment, emotional disturbance, multiply disabled, learning disabled, physically challenged, neurological impairment and visual impairment and provisionally amended on July 18, 2002 to add authority for the corporation to operate grades seven through twelve for students with disabilities including, but not limited to, mental retardation, hearing impairment, speech and language impairment, emotional disturbance, multiply disabled, learning disabled, physically challenged, neurological impairment, visual impairment and autism. The board of trustees has applied for an extension of the amendments to the absolute charter that were granted on October 5, 2001 and July 18, 2002. The Office of Vocational and Educational Services for Individuals with Disabilities (VESID) has been provided with an opportunity to review this action, and the trustees have been advised that the granting of an amendment to the absolute charter does not constitute approval for State funding for programs and services under the jurisdiction of VESID’s Office for Special Education Services (OSES). The Office of Nonpublic School Services recommends that the absolute charter be amended accordingly for a provisional term of three years.

Yonkers, Westchester County

 

The board of trustees has petitioned the Board of Regents to form a corporation to  operate pre-school and nursery school programs, after-school care and summer camping opportunities and day care centers in Westchester County. The Office of Children and Family Services (OCFS) has consented to this action pursuant to §460-a of the Social Services Law. The Office of Nonpublic School Services recommends that a provisional charter be granted for a period of one year.

The board of trustees has petitioned the Board of Regents to form a corporation to  operate a pre-school for children with and without disabilities from three to five years of age and to operate day care centers. The Office of Children and Family Services (OCFS) has consented to this action pursuant to §460-a of the Social Services Law. The Office of Nonpublic School Services recommends that a provisional charter be granted for a period of one year.

A provisional charter was granted to this corporation by action of the Board of Regents  on April 4, 2000 to operate a  preschool, kindergarten, a before- and after-school program and a day care center. The board of trustees has applied for an amendment to the provisional charter to specify that the preschool and kindergarten enrolls children with or without disabilities and to add authority for the corporation to also operate a summer program and, as so amended, extended. The Office of Nonpublic School Services recommends that the provisional charter be amended accordingly and, as so amended, extended for three years to allow the corporation additional time to develop its programs and otherwise demonstrate that it can meet the requirements for an absolute charter.

A provisional charter was granted to this corporation by action of the Board of Regents  under the corporate name “New Paltz Waldorf School “ on May 20, 1983 to operate a  nursery school, kindergarten and an elementary school. Such provisional charter was amended by Regents action on April 24, 1987 to change the name to Mountain Laurel School – A Waldorf School,” and, as so amended, extended and amended, extended on January 23, 1991, and further amended by Regents action on September 13, 1991 to change the corporate name to “Mountain Laurel Waldorf School.” The board of trustees has applied for an amendment to the provisional charter to change the corporate address to 16 S. Chestnut Street, New Paltz, New York 12561 with a mailing address of P.O. Box  939, New Paltz, New York 12561 and, as so amended, extended. The Office of Nonpublic School Services recommends that the provisional charter be amended accordingly and, as so amended, extended for three years to allow the corporation additional time to develop its programs and otherwise demonstrate that it can meet the requirements for an absolute charter.

Such provisional charter was amended on June 26, 1964 by action of the Board of Regents and was extended by action of the Board of Regents on October 29, 1965. Such provisional charter was made absolute by action of the Board of Regents on January 26, 1967. Such absolute charter was amended by action of the Board of Regents on March 28, 1969 to change the corporate name to “Hilbert College” and change the corporate purposes, and further amended on March 23, 1992 and November 9, 2001. The board of trustees has applied for an amendment to the absolute charter to increase the maximum number of authorized trustees from 25 to 35. The Office of Higher Education recommends that the absolute charter be amended accordingly.

An absolute charter in the first instance was granted to this corporation by action of the Board of Regents under the corporate name “The Ithaca Conservatory and Affiliated Schools” on January 21, 1926 to establish an institution of higher education providing instruction in all branches of music, elocution, physical education and selected fine arts. Such absolute charter was amended by Regents action on March 19, 1931 to change the corporate name to “Ithaca College,” February 19, 1943, September 15, 1950, May 24, 1957, April 25, 1958, October 27, 1972, January 17, 1984, September 23, 1994, February 8, 2000 and December 17, 2004.  The board of trustees has applied for an amendment to the absolute charter to increase the maximum number of authorized trustees from 28 to 35. The Office of Higher Education recommends that the absolute charter be amended accordingly.

A provisional charter without degree-conferring powers was granted to this corporation by action of the Board of Regents on February 11, 1892. Such provisional charter was made absolute by Regents action on March 27, 1924. Such absolute charter was amended by Regents action on May 16, 1929, May 20, 1938, March 20, 1942, February 15, 1951,  July 14, 2000, and July 19, 2001. The board of trustees has applied for an amendment to authorize the corporation to establish a branch campus at Corning Community College, Corning, New York.
