SUMMARY:
The Board of Regents is authorized to approve proposed revisions to existing charters. The Riverhead Charter School has submitted an amendment that would allow it to expand the grade levels served from K-5 to K-7 for the 2004-05 school year. The maximum number of students would not increase from the current maximum of 540 students, so there would be no increase in the estimated potential fiscal impact upon the sending districts. The school has been experiencing several significant problems regarding compliance with law and charter provisions. The school should focus its efforts on addressing these problems before adding additional grades.
The Board of Regents is also authorized to approve revisions to existing charters submitted from other charter entities. The Chancellor of the New York City Department of Education via the Office of New School Development has submitted an amendment for the Explore Charter School (ECS). The proposed revision for the Explore Charter School is to amend the stated performance outcomes to include city assessments and school-specific priorities for student achievement, parent involvement, and student attendance. Additionally, the Chancellor is requesting that the ECS Board of Trustees be allowed to increase the voting privileges of the teacher and PTA representatives who serve on the board.
The Trustees of the State University of New York have submitted a proposed revised charter for the Carl C. Icahn Charter School that allows the school to expand its approved program to add a fifth grade for the remaining years of the charter and to set its maximum enrollment at 216 students in the 2004-2005 and 2005-2006 academic years. The Trustees have also submitted to the Board of Regents a proposed revision to the charter for the Child Development Center of the Hamptons Charter School. The proposed revision is to allow the school to extend the grade levels it serves from K-6 to K-7 and to increase its targeted enrollment for the 2004-05 school year to 85 students.
The estimated potential fiscal impact upon the district of location for the Explore Charter School will not change, based on the requested revisions. The estimated potential fiscal impact for the Carl C. Icahn Charter School and the Child Development Center of the Hamptons Charter School is provided in the attached.

VOTED: That the Board of Regents deny the proposed revisions to the charter of the following charter school for the reasons discussed above:

VOTED: That the Board of Regents approve the proposed revisions to the charter of the following charter schools based upon the information contained in the attachments and upon a finding by the Board of Regents that: (1) the revisions meet the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules, and regulations; (2) the revisions (together with the other terms of the charter) will permit the charter schools to operate in an educationally and fiscally-sound manner; and (3) the revisions (together with the other terms of the charters) are likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of Article 5 of the Education Law:

· Child Development Center of the Hamptons Charter School
