Report of Regents Professional Practice Committee to The Board of Regents

The Professional Practice Committee held its scheduled meeting on October 17, 2023.  All members were present, except for Regent Christine D. Cea, and Regent Catherine Collins, who were excused. Chancellor Lester W. Young, and Regent Susan W. Mittler also attended the meeting, but did not vote on any action. 

ACTION ITEMS

Professional Discipline Cases [PCC EXS (A) 1 - 3]

The Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 5 cases.  In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 29 consent order applications and 17 surrender applications be granted.

These recommendations are made following the review of 51 cases involving fourteen licensed practical nurses, thirteen registered professional nurses, five certified public accountants, five massage therapists, two licensed practical nurses who are also registered professional nurses, two registered professional nurses who are also nurse practitioners in Family Health, one architect, one licensed master social worker, one licensed master social worker who is also a licensed clinical social worker, one licensed mental health counselor, and one ophthalmic dispenser.

Restorations [PPC EXS (A) 4 - 6]

The Committee recommends that the application of Suzette Guzman-Moore for the restoration of her license to practice as a Licensed Practical Nurse in New York State be denied. [PPC EXS (A) 4]

The Committee recommends that the application of Pavel I. Kulik for the restoration of his license to practice as a Physician in New York State be denied. [PPC EXS (A) 5]

The Committee recommends that the application of Matthew D. Mendelow for the restoration of his license to practice as a Registered Professional Nurse in New York State be granted. [PPC EXS (A) 6]

Proposed Amendment of Subdivision (a) of Section 64.7 of the Regulations of the Commissioner of Education Relating to the Execution by Registered Professional Nurses of Non-Patient Specific Orders to Administer Immunizing Agents Against Respiratory Syncytial Virus [PPC (A) 1] - Department staff presented for emergency action proposed amendments to the Commissioner’s regulations to add Respiratory Syncytial Virus (RSV) vaccine to the list of immunizations that nurses can administer to patients pursuant to non-patient specific orders issued by a licensed physician or a certified nurse practitioner. 

The Committee recommends that subdivision (a) of section 64.7 of the Regulations of the Commissioner of Education be amended, as submitted, effective October 17, 2023, as an emergency action, upon a finding that such action is necessary for the preservation of the public health and general welfare to immediately improve New Yorkers’ access to Respiratory Syncytial Virus immunizations.

The motion passed unanimously.

Proposed Amendment to Section 66.5 to the Regulations of the Commissioner of Education Relating to Optometrist’s Certification to Use Therapeutic Drugs [PPC (A) 2] - Department staff presented for emergency action proposed amendments to conform the Commissioner’s regulations to Chapter 506 of the Laws of 2021 (Chapter 506), which effective October 25, 2023, authorizes licensed optometrists, who meet certain requirements, to obtain certification to prescribe certain oral medications.  

The Committee recommends that section 66.5 of the Regulations of the Commissioner of Education be added, as submitted, effective October 25, 2023, as an emergency action, upon a finding that such action is necessary for the preservation of the public health and general welfare in order to timely implement certain provisions of Chapter 506 of the Laws of 2021, which become effective October 25, 2023.

The motion passed unanimously.

Proposed Amendment to Section 52.12 to the Regulations of the Commissioner of Education Relating to the  Requirements for Clinical Education and Simulation Experience in Nursing Education Programs [PPC (A) 3] - Department staff presented for emergency action proposed amendments to conform the Commissioner’s regulations to Chapter 134 of the Laws of 2023 (Chapter 134), which effective November 11, 2023, requires nursing education programs leading to a certificate or degree to include clinical education or its equivalent and allows one-third of such clinical education to be completed through simulation experience.

The Committee recommends that section 52.12 of the Regulations of the Commissioner of Education be added, as submitted, effective November 11, 2023, as an emergency action, upon a finding that such action is necessary for the preservation of the public health and general welfare in order to timely implement the provisions of Chapter 134 of the Laws of 2023, which becomes effective November 11, 2023.

The motion passed unanimously.

MOTION FOR ACTION BY FULL BOARD

The Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on October 17, 2023, copies of which have been distributed to each Regent.

MATTERS NOT REQUIRING BOARD ACTION

Deputy Commissioner Sarah Benson reviewed the items on the Consent Agenda.
