Report of Regents Professional Practice Committee to The Board of Regents
Your Professional Practice Committee held its scheduled meeting on October 22, 2013. All Committee members were present, except for Regent James E. Cottrell, who was excused. Chancellor Merryl H. Tisch and Regent Kathleen M. Cashin were also present, but did not vote on any case or action.
ACTION ITEMS
Professional Discipline Cases
Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 3 cases, and further recommends that 1 summary suspension be denied. In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 28 consent order applications and 1 surrender application be granted. [PPC EXS (A) 1-3]
These recommendations are made following the review of 33 cases involving ten licensed practical nurses, four registered professional nurses, three dentists, two certified public accountants, two licensed master social workers, two licensed practical nurses who are also registered professional nurses, two pharmacists, one architect, one architecture professional corporation, one licensed clinical social worker, one massage therapist, one podiatrist, and one psychologist.
Restorations
Your Committee recommends the following:
That the revocation of the license of Richard Genco to practice as a dentist in the State of New York be stayed; that he be placed on probation for a period of two years under the terms of probation of the Board of Regents; and that, upon successful completion of his probation, his license be fully restored. [PPC EXS (A) 4]
That the application of Alexander Ivashenko for the restoration of his license to practice as a physical therapist in the State of New York be granted. [PPC EXS (A) 5]
That after she has passed the North American Pharmacist Licensure Examination (NAPLEX) and the Multistate Pharmacy Jurisprudence Exam (MPJE) and has so notified the Director, Office of Professional Discipline (OPD), and the Director determines that she satisfactorily met such conditions, it is recommended that the revocation of the license of Frances Ma to practice as a pharmacist in the State of New York be stayed; that, upon her actual return to practice as a pharmacist in the State of New York, of which she shall notify the Director, OPD at least seven days in advance of her actual return to practice, she be placed on probation for one year under the terms and conditions set forth in the Exhibit A to the Report of the Committee on the Professions; and that, following successful completion of her probation, her license be fully restored. Approvals
Your Committee recommends approval of the following:
Regulations Relating to Continuing Competency Requirements in Occupational Therapy [PPC (A) 1] – That section 76.10(c)(2)(iii)(b), section 76.10(c)(2)(iii)(c)(2), section 76.10(g)(2), and section 76.10(i)(2)(i) of the Regulations of the Commissioner of Education be amended and that a new section 76.10(j)(3) of the Regulations of the Commissioner of Education be added, all as submitted, effective November 6, 2013.

Madam Chancellor and Colleagues: Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on October 21, 2013, copies of which have been distributed to each Regent.
