MATTERS NOT REQUIRING BOARD ACTION
Proposed Amendment to Part 126 of the Regulations of the Commissioner Relating to Standards of Financial Viability, Accountability, and Evaluating Academic Progress in Licensed Private Career Schools and Certified English as a Second Language Schools – The Committee was provided with information from staff regarding the current regulation requirements for a licensed private career school to submit annual financial statements and how an amendment to this regulation will create a transparent framework and process for assessing the financial viability of all licensed private career schools and certified ESL schools. The framework for this amendment is adapted from the United States Department of Education’s system of evaluating the financial viability of postsecondary schools. Following the 60-day public comment period required under the State Administrative Procedure Act, it is anticipated that the proposed rule will be presented to the Board of Regents for permanent adoption at the September 2021 Regents meeting. If adopted, the proposed amendment will become effective on September 29, 2021.
