Report of Regents Professional Practice Committee to The Board of Regents

Your Professional Practice Committee held its scheduled meeting on February 11, 2020. All members were present except Regent Susan W. Mittler. Chancellor Betty A. Rosa and Regent Cashin were also present but did not vote on any case or action.

Professional Discipline Cases

Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 2 cases.  It is noted that the number of reports of the Regents Review Committees that were accepted has been corrected.  In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 37 consent order applications and 12 surrender applications be granted.

In the cases of Denise Ann Hoag, Licensed Practical Nurse & Registered Professional Nurse, Calendar Nos. 31447 & 31448, Regent Catherine Collins abstained.

These recommendations are made following the review of 51 cases involving sixteen registered professional nurses, ten licensed practical nurses, six pharmacists, four pharmacies, two licensed practical nurses who are also registered professional nurses, two professional engineers, two psychologists, one dentist, one land surveyor, one massage therapist, one professional engineering professional limited liability company, one registered professional nurse who is also a nurse practitioner (Family Health), and one veterinarian.

Madam Chancellor and Colleagues: Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on February 11, 2020, copies of which have been distributed to each Regent.

Proposed Amendment to Section 60.2 of the Regulations of the Commissioner of Education Relating to the Term Limits for Members of the Advisory Committee on Long-Term Clinical Clerkships (Discussion)

Advisory Committee members are currently limited to two successive four-year terms unless one of the preceding terms was less than two years in duration. The proposed amendment would remove the provisions prohibiting members of the Committee from serving more than two terms in succession, which would allow the Chancellor and the Board of Regents to have greater flexibility in providing the Advisory Committee with the expertise needed to address issues that arise in the Advisory Committee’s work, while still retaining the ability to appoint additional Advisory Committee members as needed.

Proposed Amendment to Sections 59.14, 72.2, , 74.5, 74.6, 79-9.3, 79-10.3, 79-10.9, 79-11.3, and 79-12.3 and Addition of Sections 72.6, 79-9.9, 79-11.9, 79-12.9  the Regulations of the Commissioner of Education to Implement Provisions of Part Y of Chapter 57 of the Laws of 2018 Regarding the Practice of the Psychology, Social Work and Mental Health Practitioner Professions (Discussion)

The proposed amendment implements the provisions of Part Y of Chapter 57 of the Laws of 2018, which amended the Education Law related to the practice of social workers, psychologists and mental health practitioners, including activities that do not require licensure or may be performed by authorized individuals in certain programs and services. Chapter 57 requires the Board of Regents to adopt regulations to implement the law and the adoption of those regulations will end an exemption from licensure for certain individuals one year after their final adoption.
