Your Professional Practice Committee held its scheduled meeting on December 10, 2019. All members were present. Chancellor Betty A. Rosa and Regent Cashin were also present but did not vote on any case or action.

Professional Discipline Cases
Your Committee recommends, upon the recommendation of the Committee on the Professions, that 38 consent order applications and 6 surrender applications be granted.
These recommendations are made following the review of 44 cases involving eleven licensed practical nurses, nine registered professional nurses, four pharmacists, two architects, two massage therapists, two physical therapists, one acupuncturist, one certified public accountant, one dentist, one licensed master social worker, one licensed practical nurse who is also a registered professional nurse, one pharmacy, one professional engineer, one professional engineer professional corporation, one registered professional nurse who is also a nurse practitioner (Adult Health), one registered professional nurse who is also a nurse practitioner (Family Health), and one veterinary technician.
In the matters of Patricia Jean Kendall a/k/a Patricia J. Kendall-Cargill, R.N.*, N.P. (Family Health) (31116, 31117), these matters were the subject of a motion to sever and to consider separate and apart from the balance of the calendar, and were separately approved by Committee vote, with Regent Collins abstaining.

Madam Chancellor and Colleagues: Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on December 10, 2019, copies of which have been distributed to each Regent.

Proposed Amendment to Section 70.9 of the Regulations of the Commissioner of Education Relating to Continuing Education in the Profession of Public Accountancy (Emergency Action)
The proposed amendment conforms the regulation to Chapter 413 of the Laws of 2018, which, effective January 1, 2020, amends the Education Law by eliminating the three-year exemption from mandatory continuing education for newly licensed certified public accountants.
Proposed Amendment to Section 79-13.5 of the Regulations of the Commissioner of Education Relating to the Establishment of a New Restricted Licensed for Clinical Laboratory Technologists in Toxicology (Emergency Action)
The proposed amendment conforms the regulation to Chapter 227 of the Laws of 2019, which, effective December 28, 2019, amends the Education Law by establishing a new restricted license for clinical laboratory technologists in toxicology and allows individuals employed by a New York State Department of Health certified laboratory, who meet the requirements for a restricted license, to receive a certification allowing them to perform toxicology laboratory services.
