Report of Regents Professional Practice Committee to The Board of Regents

Your Professional Practice Committee held its scheduled meeting on June 17, 2013. All Committee Members were present, except for Vice-Chancellor Anthony S. Bottar, who was excused. Chancellor Merryl H. Tisch was also present, but did not vote on any case or action.  

ACTION ITEMS

Professional Discipline Cases

Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 4 cases. In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 33 consent order applications and 8 surrender applications be granted. [PPC EXS (A) 1-3]

These recommendations are made following the review of 45 cases involving twelve registered professional nurses, eight licensed practical nurses, three certified public accountants, three licensed practical nurses who are also registered professional nurses, two dentists, two professional engineers, two psychologists, one architect, one audiologist, one clinical laboratory technician, one licensed clinical social worker, one licensed master social worker, one massage therapist, one pharmacist, one physical therapist, one physical therapist assistant, and one registered public accountancy partnership.

Restorations

Your Committee recommends that the application of Robert David Lee for the restoration of his license to practice as a pharmacist in New York State be denied. [PPC EXS (A) 4]

Your Committee recommends that the application of Niels Lauersen for the restoration of his license to practice as a physician in New York State be denied. [PPC EXS (A) 5]

Approvals

Your Committee recommends approval of the following:

Regulations Relating to Pharmacy [PPC (A) 1] –That sections 63.11 and 63.12 of the Regulations of the Commissioner of Education be added, as submitted, effective July 3, 2013; and

That sections 63.11 and 63.12 of the Regulations of the Commissioner of Education be added, as submitted, effective June 27 2013, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the public health and general welfare to ensure that the proposed amendment remains continuously in effect until it can be adopted as a permanent rule on July 3, 2013.

Regulations Relating to Acupuncture [PPC (A) 2] – That paragraph (2) of subdivision (d) of section 3.47 of the Rules of the Board of Regents and paragraph (36) of subdivision (b) of section 3.50 of the Rules of the Board of Regents be added, as submitted, effective July 3, 2013.

Madam Chancellor and Colleagues: Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on June 17, 2013, copies of which have been distributed to each Regent.

Role of the Professional Assistance Program (Information/Discussion) – Staff provided information on issues faced by health care professionals with alcohol and substance abuse problems and the resources available to such professionals, and answered questions from the Committee. [PPC (D) 1]
