Report of Regents Professional Practice Committee to The Board of Regents

Your Professional Practice Committee held its scheduled meeting on April 12, 2022.  All members were present except Regent James E. Cottrell, Regent Catherine Collins, and Regent Elizabeth S. Hakanson. As an ex-officio Member, Chancellor Lester W. Young, Jr. voted on professional discipline cases and restorations. Regent Roger Tilles, Regent Kathleen M. Cashin, Regent Luis O. Reyes, Regent Susan W. Mittler, Regent Aramina Vega Ferrer, and Regent Shino Tanikawa also attended the meeting, but did not vote on any case or action.

ACTION ITEMS

Professional Discipline Cases

Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 2 cases.  In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 29 consent order applications and 9 surrender applications be granted.

These recommendations are made following the review of 40 cases involving thirteen registered professional nurses, five licensed practical nurses, four licensed practical nurses who are also registered professional nurses, three dental hygienists, two certified public accountants, two dentists, two pharmacists, one pharmacy, one registered professional nurse who is also a nurse practitioner in Psychiatry, and one respiratory therapy technician who is also a respiratory therapist.

Restorations

Your Committee recommends the following:

That the application of Mark J. Nepokroeff for the restoration of his license to practice as a Physician in New York State be denied and further, that said license be annulled. [PPC EXS (A) 4]

Chancellor and Colleagues: Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on April 12, 2022, copies of which have been distributed to each Regent.

Proposed Repeal of Section 68.1 and Addition of a New Section 68.1 and Amendment of Section 68.3 of the Regulations of the Commissioner of Education Relating to the Licensure Requirements for Professional Engineers (Emergency Action)

The proposed amendments implement Chapter 465 of the Laws of 2021 (Chapter 465), which, effective April 6, 2022, amended the Education Law to update the engineering licensure requirements to reflect modern practice requirements and promote uniformity for the profession.

Proposed Amendment to Sections 72.6 and 74.10 and Subparts 79-9.8, 79-10.8, 79-11.8 and 79-12.8 of the Regulations of the Commissioner of Education Relating to Continuing Education Requirements for Psychologists, Social Workers and Mental Health Practitioners (Discussion)

The proposed amendments to the Commissioner’s Regulations would require psychologist, licensed master social workers, licensed clinical social workers, creative arts therapists, marriage and family therapists, mental health counselors, and psychoanalysts to complete three continuing education credits, from Department approved providers, related to maintaining appropriate professional boundaries with patients/clients each triennial registration period.
