Proposed Amendment of Section 200.5 of the Regulations of the Commissioner of Education Relating to Special Education Due Process Hearings - Department staff will present a proposed amendment for emergency action to clarify that parents of students who are parentally placed in nonpublic schools do not have the right under Education Law § 3602-c to file a due process complaint regarding the payment of services; when such services were recommended by the district on an Individualized Education Services Plan (IESP) and were obtained by the parents of a student with a disability. |

Higher Education/P-12 Education Joint Meeting
Proposed Amendment of Section 100.2 of the Regulations of the Commissioner of Education Relating to Completion of the Free Application for Federal Student Aid (FAFSA) by Seniors Enrolled in School Districts - Department staff will present a proposed regulatory amendment for adoption as an emergency rule to require school districts to: ensure that parents or guardians of high school seniors (or students if they are 18 years old or older or legally emancipated) complete the FAFSA, DREAM Act application, or waiver indicating that they have chosen not to file an application; notify each high school senior at least twice in a school year of the state-sponsored scholarships, financial aid, and assistance available for college or post-secondary education; and annually report to the Department certain data for all seniors in the district. Proposed Amendment of Sections 80-2.9, 80-4.3, and 80-5.18 of the Regulations of the Commissioner of Education Relating to Flexibilities for the Supplementary Certificate and Supplementary Bilingual Education Extension Requirements in Response to the Influx of Recently Arrived and Asylum-Seeking Students - Department staff will present proposed regulatory amendments for adoption as an emergency rule to extend the flexibilities for the Supplementary certificate and Supplementary Bilingual Education extension requirements for certain educators who apply for this type of certificate and extension from August 31, 2024 to August 31, 2025. |

Proposed Amendment of Section 80-5.27 of the Regulations of the Commissioner of Education Relating to Extending the Validity Period of Emergency COVID-19 Certificates - Department staff will present a proposed regulatory amendment for adoption as an emergency rule to extend the validity period of COVID-19 certificates that expire on August 31, 2024 or January 31, 2025 by changing the expiration date of such certificates to August 31, 2025. Proposed Amendment of Section 80-5.3 of the Regulations of the Commissioner of Education Relating to Extending Flexibility for Incidental Teaching - Department staff will present a proposed regulatory amendment for adoption as an emergency rule to extend the flexibility for incidental teaching where certified teachers can teach up to 10 classroom hours a week in a subject area not covered by their certificate through the 2024-2025 school year. |
