Summary

Should the Regents approve the recommendations of the Committee on the Professions pertaining to licensing petitions as listed on the attachment?
Proposed Handling
This question will come before the Professional Practice Committee at its March 2009 meeting where it will be voted on and action taken. It will then come before the full Board at its March 2009 meeting for final action.
Procedural History
Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.
Background Information
There is one licensing petition and 16 requests for the conferral of the degree Doctor of Medicine for review and approval.
Recommendation
It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.
Timetable for Implementation
Approval of the Committee on the Professions’ recommendations will be effective March 17, 2009.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.
Statement of Problem: During the last three quarters of 2006, the Uniform CPA Examination was subject to an undetected scoring anomaly that resulted in approximately 200 New York State applicants being given an incorrect grade that was lower than it should have been. This anomaly was detected and corrected in 2007. Affected Examinations were re-scored, with the corrected scores being reported to applicants in May 2007 and the State Board in June 2007. In a small number of cases, a candidate who had actually passed a section, but received an erroneous score notice telling them that they had failed, sat for the section again and failed it during the subsequent sitting. For such cases, the Executive Secretary of the State Board for Public Accountancy recommended that the candidate be granted conditional credit for the section that was erroneously reported to them as a fail, and that the subsequent failing grade be disregarded.
Mr. McClung is one of the applicants affected by this anomaly. He has a second related issue in that he passed his fourth section of the Examination four months outside of the 18-month conditioning period. Mr. McClung sat for the Financial Accounting and Reporting (FAR) section of the computer-based Examination in November 2006. Due to the scoring anomaly he was told he had received a failing grade on that section. He then prepared and sat for the FAR section again in the next subsequent testing window, January 2007, and again failed the section. As he was preparing to sit for the FAR section a third time, in the April/May 2007 testing window, CPA Examination Services notified him by phone of the scoring anomaly and told him that he had actually passed the November 2006 FAR section. He received an official letter confirming his passing Examination score on the November 2006 FAR section from CPA Examination Services on May 8, 2007.
Once he had been notified of his passing score on the FAR section, albeit five months after he had actually sat for that section, Mr. McClung turned his attention to passing the remaining three sections. He passed Auditing (AUD) in July 2007, Business Environment and Concepts (BEC) in May 2008, and Regulation (REG) in October 2008, four months outside of the 18-month conditioning period.
Based on the scoring anomaly, the Executive Secretary of the State Board for Public Accountancy supports Mr. McClung’s petition to disregard his subsequent failing score on the FAR section and waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Public Accountancy, recommends that the applicant’s petition for acceptance of passing grades on the Uniform CPA Examination be accepted.

MEDICINE
Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.
Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.
The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
