Proposed Handling
This question will come before the Professional Practice Committee at its October 2008 meeting where it will be voted on and action taken. It will then come before the full Board at its October 2008 meeting for final action.
Procedural History
Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.
Background Information
There are 9 licensing petitions and 12 requests for the conferral of the degree Doctor of Medicine for review and approval.
Recommendation
It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.
Timetable for Implementation
Approval of the Committee on the Professions’ recommendations will be effective October 21, 2008.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy Examination.
Statement of Problem: Ke Ni, an applicant for licensure as a certified public accountant, passed all four parts of the Uniform CPA Examination; however, she exceeded the 18-month conditioning requirements by six months.
Ms. Ni originally received credit for passing the Financial Accounting and Reporting (FAR) section of the examination in April 2006. She subsequently passed the Business Environment and Concepts (BEC) section in October 2006 and the Regulation (REG) section in April 2007. Ms. Ni needed to pass the fourth section, Auditing and Attestation (AUD), by December 31, 2007 to retain credit for the FAR section she passed in April 2006. She passed the AUD section in May 2008, six months after losing credit for the FAR section.
Ms. Ni had scheduled to take the AUD section in November 2007, within the 18-month conditioning period; however, due to documented medical reasons, she had to cancel. Ms. Ni passed the AUD section in May 2008.
Based on the documentation from Ms. Ni’s physician, the Executive Secretary of the State Board for Public Accountancy supports her petition to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy Examination.
Statement of Problem: Holly Belcher, an applicant for licensure as a certified public accountant, has applied to transfer her examination scores from the state of Georgia. Ms. Belcher passed the four sections of the Uniform CPA Examination in Georgia under standards that are different than New York. She has not been licensed in Georgia.
The computer based version of the Uniform CPA Examination was initiated in April 2004. Georgia allowed applicants who sat for the computer based examination in the first six months it was administered to retain conditional credit for sections passed for 24 months rather than the 18-month requirement in New York. Ms. Belcher passed the Regulation (REG) section in July 2004 and had until the end of July 2006 to pass the remaining sections under Georgia standards. Ms. Belcher passed the Auditing and Attestation (AUD) section in October 2005, the Business Environment and Concepts (BEC) section in November 2005 and the Financial Accounting and Reporting (FAR) section in May 2006. Ms. Belcher has been working for a large public accounting firm for the past four years and is petitioning to have her examination scores from Georgia accepted as meeting New York’s requirements.
The Executive Secretary of the State Board for Public Accountancy supports her request to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

Petition for: Waiver of education requirements.
Statement of Problem: Ms. Liu submitted an application for licensure (dated November 9, 1995) prior to the deadline for consideration under the grandparenting (alternative) provisions. For the grandparenting alternative education pathway, the Department determined that the applicant lacked four semester credits in the professional dietetics and nutrition content area, including coursework in dietetic counseling. The grandparenting requirements stipulated that the education requirements needed to be completed by January 1, 1996 (the end of the grandparent period). Ms. Liu was not notified until after that date that she had education deficiencies.
The New York State Board for Dietetics and Nutrition considered her application at its May 2008 meeting. The Board supported issuance of a license and recommended that her “extensive experience, in dietetics and nutrition both in the U.S. and in China, her masters degree in nutrition from Brooklyn College, her medical degree and her active practice of integrative medicine within the Veterans Administration Hospital exceed any content that she might receive during 4 credits of coursework in dietetics and nutrition.”
In addition, the American Dietetic Association has informed the Department that Ms. Liu has been a member since June 1, 2007. Had she been a member prior to January 1, 1996, she would have qualified for licensure under the grandparenting provisions.

Petition for: Acceptance of education.
Statement of Problem: Commissioner’s Regulations require the completion of two years of pre-professional education with required subjects prior to matriculation into the professional dental program. Dr. Tasgaonkar completed one year of pre-professional education prior to beginning her dental program. She covered all the required subject areas except for organic chemistry. Following graduation from dental school, she successfully completed a Master of Dental Surgery program in Prosthetic Dentistry at Nair Hospital Dental College (1982). The Acting Executive Secretary of the State Board for Dentistry recommends that Dr. Tasgaonkar’s master’s program fulfill the pre-professional deficiencies. Commissioner’s Regulations allow the Committee on the Professions to accept up to 30 semester hours of study completed after the professional program toward the pre-professional requirement.
Additionally, Dr. Tasgaonkar did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school. Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. Dr. Tasgaonkar enrolled in the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester and successfully completed the program in June 2008. This program is acknowledged by the State Board for Dentistry as the substantial equivalent of the two-year program required in regulation.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Acting Executive Secretary of the State Board for Dentistry, recommends that the applicant's successful completion of the advanced program in general dentistry at the University of Rochester be accepted as the substantial equivalent of the required two academic years of dental study in a registered or accredited dental school program. In addition, the Committee recommends the acceptance of the master’s degree as fulfilling the pre-professional education deficiencies.

THREE-YEAR LIMITED LICENSE IN DENTISTRY
Petition for: Three-year limited license to practice Dentistry under Section 6604(6) of the Education Law.
Statement of Problem: The applicants listed below have satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.
Each applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. Each applicant must sign an affidavit stating the exact location of the shortage area where he/she will practice before the three-year limited license will be issued.
Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

Statement of Problem: The applicant listed below has met the education and examination requirements for licensure as veterinary technicians in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.
The applicant also has a pending application for full veterinary technology licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.
Applicable Guidelines: Section 6711(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a veterinary technician in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien veterinary technician to practice in New York State if all other licensure requirements are satisfied.

Petition for: Satisfaction of the postgraduate hospital training requirement and endorsement of his medical license from New South Wales, Australia.
Statement of Problem: Commissioner’s Regulations allow endorsement of an applicant’s license from another jurisdiction if appropriate requirements are met, and the applicant has not failed any part of New York State’s licensing examination. A license granted in a country outside the United States can be endorsed if licensure in that country is regulated by an organization designated as responsible for quality assurance and acceptable to the Board of Regents. Additionally, the applicant must satisfactorily demonstrate completion of an acceptable clinical competency examination, three years of ACGME-accredited postgraduate training or the equivalent, and five years of satisfactory professional experience.
Dr. Glare has not failed any part of the licensing examinations used by New York State. The Executive Secretary of the State Board for Medicine has reviewed the documentation submitted in support of Dr. Glare’s application. He recommends that Dr. Glare’s six years of postgraduate training in internal medicine and palliative medicine in New South Wales, Australia and Australian specialty certificates in pain medicine and palliative medicine be accepted as the substantial equivalent of the three years of ACGME-accredited postgraduate training required for licensure. Commissioner’s Regulations allow the Board of Regents to accept appropriate foreign medical licenses and diplomate certificates to fulfill the licensure and clinical competency requirements for endorsement. Dr. Glare has been licensed by the New South Wales Medical Board since 1981. His license is active and in good standing. In addition, the applicant was admitted to the Fellowship of the Royal Australasian College of Physicians in 1990. The Board of Regents, upon the recommendation of the Executive Secretary of the State Board for Medicine and the Committee on the Professions, has previously accepted these qualifications to fulfill the regulatory endorsement requirements for licensure.

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.
Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.
The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
