SUMMARY:
The Board of Regents is authorized to approve proposed revisions to existing charters. The Trustees of the State University of New York have approved an amendment for the Child Development Center of the Hamptons Charter School. Specifically, the Trustees have approved the school to increase the grade levels offered from K-5 to K-6 starting in September 2003. Copies of materials submitted by the Trustees of the State University of New York are available upon request from the Secretary of the Board of Regents.
The Board of Regents is further authorized to order dissolution of a charter school education corporation, upon application of at least three-fourths of the trustees of the corporation, if the Board of Regents is satisfied that there is no sufficient reason for the continuance of the corporation, and if all taxes chargeable to the corporation have been paid. On January 10, 2001, the Board of Regents granted a provisional charter to Sullivan Charter School. The charter school never opened for instruction. On May 6, 2003, the Board of Regents received a petition for the dissolution of this corporation seeking dissolution effective immediately because the school has been unable to open. A copy of the petition is attached. It is recommended that the Board of Regents dissolve the corporation because it appears from the petition that all taxes chargeable to the corporation have been paid and there are not sufficient reasons for the continuance of the corporation.
VOTED: That the Board of Regents approve the proposed revision to the charter of the following charter school based upon the information contained in the attachments and upon a finding by the Board of Regents that: (1) the revision meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules, and regulations; (2) the revision (together with the other terms of the charter) will permit the charter school to operate in an educationally and fiscally sound manner; and (3) the revision (together with the other terms of the charter) is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of Article 56 of the Education Law:

VOTED: That the provisional charter of the following charter school education corporation be dissolved effective immediately, that notice to such effect be given to the trustees of the corporation, that any student records be transferred to the Wyandanch Union Free School District in accordance with the provisions of Education Law �2851(2)(t), and that any assets of the corporation be distributed in accordance with the procedures set forth in Education Law �220:
